Identifying an Inmate a jail or prison located in Arizona may prove to be difficult for Notaries who service Jails & Prisons. If you are a family or friend of an inmate trying to get documents Notarized, worry not! The State of Arizona has specific provisions for identification for an Arizona inmate. Although this wasn't always true. Just 8 years ago it was extremely difficult for a Notary to provide Notarizations for inmates because the jail staff usually took the inmates ID and would not release it.


Today, that's all changed. Today the State of Arizona now has a specific provision in the State's Notary Handbook that allows for an Inmate Identification Card or Any form of Inmate Identification in order to properly and sufficiently identify an inmate. The specific requirements include: The inmate must be in custody of State Department of Corrections, Federal Bureau of Prisons, or County Sherriff's department. And the ID must be issued by the Arizona Department of Corrections, Federal Bureau of Prisons, or County Sherriff's Department.


The problem that family members and friends on an inmate will face when getting a document notarized in many Arizona jails and prisons is if the document sent to the facility will require additional witnesses.

Many jails will not allow the jailers or staff to act as witnesses. Or, if they do some of them do not want to put their names on documents for inmates, especially if it includes an address. There are no requirements for jail staff to act as witnesses which poses a conundrum for family members and friends who are trying to help an inmate. Some jails in Arizona will allow more than one Notary to visit the jail, however, not all will. Some only allow one single visitor at a time. Which poses a second conundrum (or just runs up a bill).


One of the best things you can do to ensure that you have a solid notary visitation with an inmate is to seek documents that do not require additional witnesses. One of the most common documents that we see in jails is a Power of Attorney. The Arizona State's Power of Attorney form by the Superior Court of Maricopa does call for an additional witness. However, you can also use a site like Law Depot to create a Power of Attorney without additional witnesses. It also gives you a little bit more control on how the form is filled out before it reaches the inmate. The cost of a single POA from law Depot is slightly less than what most Notaries will charge you to act as a witness at an Arizona jail.
